DATA PRIVACY NOTICE AND STATEMENT

(NISSAN SERVICE PR1ORITY PROGRAM) 

ILOILO CAR CORPORATION (“Nissan ILOILO” or the “Dealer”), respects your privacy and employs reasonable measures to protect your personal information in accordance with the Data Privacy Act of 2012, its Implementing Rules and Regulations, relevant issuances of the National Privacy Commission, and all data protection laws and regulations (collectively as the “Data Privacy Legislation”). This Data Privacy Notice will inform you on how we process and protect your personal information. By signing the Consent Form which is attached and made integral part of this notice, you certify that you have read and understood, and agree to, the terms below.

 

1. PERSONAL INFORMATION COLLECTED AND PROCESSED 

 

ILOILO CAR CORPORATION collects your name, signature, digital image, likeness, organization, contact information to be used to contact you [e.g., email address, mobile phone number, instant messaging username and social media account(s)]), and any demographic information to describe your interests (e.g., age range, gender, hobbies and interests) when you manually or electronically submit your inquiries or requests under the Nissan Service Pr1ority Program (“Program”). 

 

2. PURPOSES

Your personal information shall be processed for the following purposes:

  • Customer Service: to render priority customer services (e.g., preventive maintenance, warranty repair and campaign inspection) to frontline personnel in the Philippines as tribute and thanksgiving for their invaluable effort to address the Covid-19 pandemic; and  

 

  • Media Content Production: (i) for media content (e.g., advertisement, marketing campaigns, video, audio or print, etc.), featuring frontline personnel availing the program, which content will used by ILOILO CAR CORPORATION or by NISSAN PHILIPPINES, INC. (“NPI”), within the Philippine market, and may be used by NPI and other global affiliates of Nissan (collectively, the “Affiliates”) for purposes related to or similar with the program; (ii) identify the subjects in the media content; and (iii) contact regarding news-worthy matters in relation to the Program.

 

Dealer and Affiliates will not process your personal information in ways incompatible with the above-stated purposes.

 

3. METHODS OF PROCESSING

 

Your personal information shall be processed both by way of electronic or print media in compliance with the Data Privacy Legislation. Only the Dealer and its Affiliates’ authorized personnel, or its service providers, can access, use, and process your personal information, on a need to know basis, and in relation to the purposes for which your personal information was collected.   

 

 

4. DATA DISCLOSURE AND TRANSFER

 

Your personal information may be shared, disclosed or transferred to the affiliates or service providers engaged to create the web content, to the extent permitted by law, and in accordance with the purposes for which your personal information has been collected, stored and processed. The affiliates and service providers are likewise obligated to observe confidentiality in the use and processing of your personal information.  

 

5. DATA RETENTION 

 

Your personal information will be retained or stored for one (1) year from the date of signing or electronic transmission of written consent, digital signature, or emailed response; after which your personal data shall be deleted or anonymized, or an earlier period should you revoke your consent by sending a written notice of revocation of consent personally or by courier at its office address, or through email at joy.balasoto@alagroupph.com and dpo@nissan.ph. Dealer shall, within two (2) working days from receipt of your written request, delete your personal information from its record and/ or cause the deletion of our personal information from the records of the Affiliates.  Please be advised that deletion of your personal information may render the Dealer and/or the Affiliate unable to provide you with the services necessary to maintain and/or repair your vehicle.

 

6. DATA PROTECTION MEASURES

 

Dealer has put in place physical, electronic, and managerial procedures designed to help prevent unauthorized access, to maintain data security, and to use correctly the personal information collected. These safeguards vary based on the sensitivity of the personal information collected, stored and processed.

 

7. DATA SUBJECT RIGHTS

 

You have the following rights under the Data Privacy Act, which you may exercise at your discretion: to access your personal information, to make corrections to personal information, to object to the processing of personal information, to suspend, withdraw or order the blocking, removal or destruction of your personal information, to be informed of the existence of processing of personal information, to damages, and to lodge a complaint before the National Privacy Commission.
